EDUCATION LAW AND POLICY
Education law and Policy is the legal discipline covering all issues pertaining to schools, from kindergarten through higher education. Historically, attorneys practicing education law have worked toward expanding access to a high-quality education for all children, as well as providing for greater access to higher education. But this practice area has expanded to include issues such as students' rights; teachers' rights; school safety; discrimination; conduct and discipline; special education; curriculum; and education options such as homeschooling and charter schools.
Together with "The European Association for Education Law and Policy" we already publish many years books and a Journal (International Journal on Education Law and Policy (IJELP)). The editors provided many interesting materials on all levels of education.

In it, thirty-four authors representing many different legal cultures have selected and commented the most significant judicial decisions in each of the jurisdictions analysed. The topics addressed include religious and cultural symbols; faith-based, religious, and citizenship education; freedom of teaching and scientific freedom; homeschooling; authorization, funding and other matters concerning denominational and private schools, among other legal disputes. The reader will easily sense many different ideological orientations throughout the book’s thirty-seven chapters, which is only the result of pluralism itself and of scientific freedom. Nevertheless, the editors believe that all of the authors have inherently favoured the desire to understand the challenges of pluralism and to convey knowledge that is relevant for a public debate rather than defending their own particular point of view. Indeed, facilitating debate might be considered to be the best achievement of a publication of this kind.

Adriaan de Groot (1914 – 2006) was professor in de psychologie aan de Universiteit van Amsterdam. De meeste mensen zullen hem niet als persoon kennen maar wel in de vorm van een van zijn belangrijkste ‘producten’, het Cito in Arnhem! Het Cito is het Centraal instituut voor toetsontwikkeling en het bekendste product van het Cito is de Cito-toets. Elke Nederlander heeft daar de laatste decennia mee van doen gehad en voor alle kinderen en ouders van nu is het inmiddels een vast gegeven in de werkwijze van ons onderwijs. Het Cito en de Cito-toets is een uitdrukking van twee bewegingen in het huidige onderwijs, maar eigenlijk veel breder, in onze maatschappij: de individualisering en de meetbaarheid. De toetsbenadering staat voor een onderwijs dat op individuele leerlingen gericht is en heeft een einde gemaakt aan wat er aan vooraf ging, het klassikale onderwijs. Was onderwijs in het eerste deel van de vorige eeuw georganiseerd naar klassen en dus in zekere zin homogeniserend, nu in groepen maar binnen de groepen geldt de individualisering. Er zijn leerlingvolgsystemen, er is vrijwel van het begin af een leerling-dossier dat heel nauwgezet en uitgebreid vermogens, ontwikkeling en resultaten weergeeft. Elke ouder mag dat ook verlangen en verlangt dat ook. Onderwijs differentieert en een kenmerk van goed onderwijs is nu de mate waarin het aan de individuele leerling de ruimte geeft voor zijn ontwikkeling. Meten, registreren en beoordelen is daarvoor essentieel en Adriaan de Groot, meer algemeen, de psychologen hebben daar de mogelijkheden voor geschapen. Hoe die mogelijkheden het best kunnen worden ingezet blijkt echter aanhoudend te leiden tot meningsverschillen.
Het denken van De Groot over toetsen was ingebed in een zienswijze op wetenschap en de betekenis van wetenschap voor de praktijk van het onderwijs en voor het onderwijsbeleid. Over de mogelijkheden die zijn benadering daar zouden hebben was hij aan de optimistische kant!
De HBO-jurist. Kans of bedreiging?

Sinds 2002 kent Nederland de HBO-Rechtenopleiding. De HBO-Rechtenopleiding is een praktijkgerichte juridische bacheloropleiding. De opleiding wil zich ten opzichte van andere hbo-opleidingen met een rechtencomponent profileren als monodisciplinaire rechtenopleiding. De opleiding wil zich van de wetenschappelijke rechtenopleiding onderscheiden door gedurende de opleiding de praktijk centraal te stellen. De HBO-Rechtenopleiding beoogt afgestudeerden af te leveren die de arbeidsmarkt ‘hands-on’ kunnen betreden. Het is interessant dat er een nieuwe juridische opleiding is gekomen in een veld waar al meerdere opleidingen met een juridische component bestonden, en waar met name de universiteiten sinds jaar en dag degenen zijn geweest die juristen afleverden op de arbeidsmarkt. De vraag rijst waarom deze nieuwe opleiding er is gekomen en of er voor deze nieuwe juristen plaats is op de arbeidsmarkt. De eerste afgestudeerden van de opleiding HBO-Rechten bevinden zich sinds september 2006 op de arbeidsmarkt. In onderhavige studie is gekeken naar de positie van de eerste lichtingen afgestudeerde hbo-juristen in het juridische landschap. Centraal staat de positie van de hbo-juristen in de klassieke juridische beroepen.
De lange weg naar een wet op het onderwijstoezicht

Het toezicht op het onderwijs wordt sinds 2002 uitgevoerd op basis van de Wet op het Onderwijstoezicht (WOT). Dat is een voor het toezicht, zoals dat door de overheid via inspecties wordt uitgevoerd, bijzondere situatie. Toezicht door inspecties vindt plaats op basis van wetgeving die een bepaald domein of activiteit reguleert en daar binnen is het toezicht opgenomen. Zo was dat voor onderwijs tot 2002 ook geregeld. In dit artikel laat ik zien hoe het onderwijstoezicht zich in de tweede helft van de vorige eeuw ontwikkelde en welke argumenten voor een specifieke wettelijke regeling in de loop van de tijd aan de orde zijn geweest.

The International Journal for Education Law and Policy (IJELP) provides a critical review of contemporary developments in education law. It combines analysis, commentary and documentation on national education legislation and European and international developments in education. The Journal gives high priority to articles, which provide a comparative perspective and offer a link between law and policy issues. Apart from scholarly articles reviewing the implementation of and new developments in educational legislation at the national, regional, European, and international levels, IJELP features special thematic reports and contains special country reports.
The articles are subject to peer review by independent referees. Published on behalf of the European Association for Education Law and Policy, in cooperation with US-ELA, SAELPA (South African Education Law and Policy Association), LEAGUE OF EDUCATION LAW (Russian Federation), ANZELA (Australia and New Zealand Education Law Association), CAPSLE (Canadian Association of the Practical Study of Law in Education), with the support of UNESCO and supra-national and international organizations.
