On the 25th of October, 1999, the UN Security Council adopted resolution 1272, whereby it was decided to create a United Nations Transnational Administration of East Timor (UNTAET) to which will be entrusted overall responsibility for the administration of East Timor, and which will be competent to exercise all legislative and executive functions, including the administration of justice, in order to try serious offenders for crimes committed during the 1999 violece following the referendum that lead to the independence from Indonesia.
By Regulation 2000/11, UNTAET created a judicial system, based on international norms concerning the administration of justice, including a special judicial mechanism that was added to the district court of Dili. Together with an appelate mechanism, these two are known as the Special Panels for Serious Crimes (SPSC). In 2005, the SPSC completed more than four years of trials.
This book provides the reader with an introduction to the situation in East Timor and with the information that lead to the introduction of the Panels.
